The user of the services or their legal representative may request access, rectification, cancellation or objection at any time to the data controller regarding the personal data concerning to them.

The request for access, rectification, cancellation or objection shall be submitted in writing to the Personal Data Privacy Department at our offices located at:

The request must contain and be accompanied by the following:

I.- Name and address, of the user of the services as well as a telephone number and other means to send notifications about your request;

  1. In order to prove their identity, the request of the natural person must be accompanied by the original and a copy of one of the following documents:
  2. Valid passport
  3. Voter ID card (INE)
  4. Professional license
  5. National Military Service card
  6. Current immigration document issued by the competent authority (in the case of foreigners).
  7. Consular Registration certificate
  8. Electronic signature protected by a valid digital certificate.

III.- In case the request is submitted through a legal representative, a power of attorney signed by the owner of the data, expressly stating that said legal representative is authorized to enforce the rights of access, rectification, cancellation and objection on behalf of the user, duly notarized before a Notary Public, must be attached to the request in order to guarantee legal certainty for both the interested party and for the institution itself. Said power shall be accompanied with some of the identification documents of the user previously mentioned in number two. Additionally, the legal representative must attach a power of attorney also notarized before a Notary Public.

IV.- The clear and precise description of the personal data with respect to which the exercise of any of the aforementioned rights is sought.

V.- Any other element or document that that indicates the location of personal data.

VI.- In the requests for rectification of personal data, the user of the services must clearly indicate, in addition to the above, the modifications to be made and provide documentation that supports their request.

V.- Within a maximum period of fifteen days, counted from the date on which the request for access, rectification, cancellation or objection was received, the responsible party will communicate to the user of the services the determination adopted, so that, if appropriate, the same is made effective within the fifteen days following the date on which the response is communicated.

VI.- In case of requests for access to personal data, and upon proof of the identity of the applicant, user of the services or legal representative, the delivery shall be made as the case may be. The deadlines indicated will be counted in business days. The obligation of access to information shall be deemed fulfilled when the personal data is made available to the user of the services; or by issuing non-certified copies, electronic documents or any other means that the user of the services is informed of once the request has been made.

VII.- The aforementioned terms may be extended only once for an equivalent period, provided that the circumstances of the case so justify.

VIII.- The data controller may deny access to the personal data, or to rectify or cancel it, or grant objection to the processing thereof, in the following cases:

  1. When the requester is not the owner of the personal data or the legal representative is not duly accredited to do so;
  2. When the personal data of the applicant is not found in the database;
  3. When the rights of a third party are violated;
  4. When there is a legal impediment, or the resolution of a competent authority restricts access to personal data or does not allow the rectification, cancellation or objection of the same;
  5. When the rectification, cancellation or objection has been previously made.

The aforementioned refusal may be partial, in which case the responsible party will carry out the access, rectification, cancellation or objection requested by the user of the services in a partial manner.

The delivery of personal data will be free of charge, and the user of the services must cover the justified shipping costs or the cost of reproduction in copies or other formats.

 

Within a maximum period of fifteen days from the date on which the request for access, rectification, cancellation or objection was received, the responsible party will communicate to the user of the services the determination adopted, so that, if appropriate, the determination adopted becomes effective within fifteen days following the date on which the response is communicated. In the case of requests for access to personal data, the delivery shall be made upon proof of the identity of the requester or legal representative, as appropriate. The deadlines indicated will be counted in business days.

The obligation of access to information shall be deemed fulfilled when the personal data is made available to the user of the services; or by issuing non-certified copies, electronic documents or any other means that the user of the services is informed of once the request has been made.

If the user of the services requests access to the data from a person who is presumed to be the responsible party and this person turns out not to be the responsible party, it will be sufficient to indicate this to the user of the services by any of the aforementioned means, in order to consider the request as fulfilled.

The data controller may deny access to the personal data, or to rectify or cancel it, or grant objection to the processing thereof, in the following cases:

  1. When the requester is not the owner of the personal data or the legal representative is not duly accredited to do so;
  2. When the personal data of the applicant is not found in the database;
  3. When the rights of a third party are violated;
  4. When there is a legal impediment, or the resolution of a competent authority restricts access to personal data or does not allow the rectification, cancellation or objection of the same;
  5. When the rectification, cancellation or objection has been previously made.

Such right shall be exercised by the user of the services free of charge, upon proof of identity to the data controller. However, if the same person repeats his request in a period of less than twelve months, the costs will not be greater than three days of the General Minimum Wage in force in the area of the person responsible for the information, unless there are substantial modifications to the privacy notice that motivate new consultations.
